Terms of Use for BetterLife: AI Wellbeing

Please read these Terms of Use (“Terms”, “Agreement”) carefully before using the mobile application BetterLife: AI Wellbeing (“the App”), provided by Ángel L. ("we", "us", "our"), an individual developer based in Poland.
These Terms constitute a legally binding agreement between you and us. By creating an account and checking the box to indicate your acceptance, you agree to be bound by these Terms. If you do not agree to these Terms, do not create an account or use the App.
1. Overview
BetterLife is a mobile application offering mental wellness support through an AI-powered chatbot and guided audio content. The App draws inspiration from Cognitive Behavioral Therapy (CBT) and Stoic philosophy to promote emotional reflection and resilience.
The App is not a substitute for therapy, professional medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, seek help from a certified mental health professional or emergency services.
2. Eligibility
You must be at least 18 years old to use the App. By creating an account and using the App, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this Agreement.
3. Accounts and Registration
To access certain features of the App (e.g., chat history, premium content), you must register an account within the App by providing your email and a display name or nickname.
You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
4. Freemium and Premium Access
The App is offered under a freemium model:
Free users receive:
Limited number of AI chat messages per week
Access to limited number of audio sessions
No access to past chat history
Premium users receive:
Unlimited chat access with the AI assistant
Full audio content
Chat history stored for up to 14 days
Premium subscriptions are handled through the platform’s billing system (Google Play Billing on Android and Apple In-App Purchases on iOS). Pricing, billing frequency, and renewal settings are managed through your store account.
5. Payments and Cancellations
Payments are processed securely via Google Play or Apple App Store. You can manage or cancel your subscription at any time through your Google or Apple account settings.
We do not process or store your payment information directly.
Refunds are subject to the refund policies of Google Play or Apple App Store.
6. Acceptable Use
By using the App, you agree not to:
Violate any applicable laws or regulations
Harass, abuse, or threaten others
Input or generate harmful, offensive, or misleading content
Use the AI in a way that is exploitative or manipulative
Attempt to reverse-engineer, copy, or extract the AI system
Use the App in a way that disrupts its functionality or compromises its integrity
We reserve the right to suspend or terminate your access without notice if we determine a violation has occurred.
7. User Responsibility and Illegal Use
You are solely responsible for the content you input into the App.
You agree not to use the App to create, transmit, or store any content that is illegal, harmful, abusive, defamatory, or otherwise prohibited by law, including but not limited to references to drugs, sexual exploitation, violence, or criminal activities.
You acknowledge that:
The App does not monitor or moderate content in real time
The developer is not responsible for user-generated content
Any use of the App to discuss or promote illegal activity is strictly prohibited and may result in account termination and legal reporting
8. AI-Generated Content
The App uses OpenAI’s API to generate content based on your inputs. You acknowledge that:
AI responses are not professional advice
Information provided may be incomplete, inaccurate, or general in nature
You are solely responsible for how you interpret and use this content
9. Intellectual Property
All intellectual property related to the App—including its logo, design, logic, audio content, and AI configuration—belongs to Ángel L. or its licensors.
You may not reproduce, distribute, or reuse any part of the App’s content without express written permission.
If you provide us with any feedback or suggestions regarding the App, you grant us the right to use such feedback for any purpose without any obligation or compensation to you.
10. Your Content and Permissions
You own the content you create and submit in the App, including your chat messages and AI customization data ("Your Content"). You are solely responsible for it.
To make the App work, you give us permission to use Your Content. Specifically, you grant us a limited permission (a "license") to process, store, and transmit Your Content solely for the purpose of providing the service to you. For example, we need this permission to send your messages to the AI service and show you your chat history.
This permission is worldwide, applies only to operating and improving the service, and ends when you delete Your Content or your account. You are not granting us any rights to use Your Content outside of the BetterLife service.
11. Disclaimers and Limitation of Liability
The App is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, secure, available at any particular time or location, or free of errors, bugs, viruses, or other harmful components.
To the maximum extent permitted by applicable law, in no event shall Ángel L. (the Developer) be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, or data, whether incurred directly or indirectly, or any other intangible losses, resulting from: (a) your access to, use of, or inability to access or use the App; (b) any bugs, errors, or inaccuracies in the AI-generated content; or (c) unauthorized access, use, or alteration of your content.
12. Termination
We may suspend or terminate your account or access to the App at any time, without prior notice, if we reasonably believe that you have violated these Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, without regard to conflict of law principles.
Any disputes shall be exclusively resolved in the courts of Warsaw, Poland.
The App is developed and operated from Poland and complies with applicable EU regulations, including GDPR.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes to this Agreement, we will provide you with notice through the App or by other means to provide you the opportunity to review the changes before they become effective. Your continued use of the App after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms. For significant changes that materially affect your rights or obligations, we may require your direct acceptance of the new Terms to continue using the App.
